Overview
The Domestic Abuse Act 2021 provides a statutory definition of domestic abuse. It defines domestic abuse as ‘abusive’ behaviour taking place between 2 personally connected parties who are aged 16 years or over.
The behaviour is 'abusive' if it involves:
- physical or sexual abuse
- violent or threatening behaviour
- controlling or coercive behaviour
- economic abuse
- psychological, emotional or other abuse such as stalking or harassment
This behaviour can be part of a single incident or a course of conduct.
The Act also recognises children as victims of domestic abuse if they see, hear or experience domestic abuse, related to either party.
