Essex LA
Appeals Processes for EYFS and National Curriculum Statutory Assessment

EYFSP Appeals
If there are complaints about the moderation process, or appeals against the outcomes of moderation, the following steps will be followed:

  • school to discuss any concerns initially with the school/setting’s designated moderator, by using the national exemplification materials
  • if the issue is not resolved, the lead moderator will contact the school by phone or email
  • the lead moderator will meet with the moderator to discuss the moderation visit and note the moderator’s account of details
  • the school will be visited by the lead moderator or the moderation manager to review the evidence and judgements, using the national exemplification materials
  • all outcomes will be documented and all parties involved in the complaint/appeal will sign
  • outcomes from the complaint/appeal will be noted in a transparent way for the headteacher and the LA to keep on record.

The authority takes any complaints or queries very seriously and will respond to and resolve them as quickly as possible.

Appeals Procedure KS1 and KS2

Very occasionally a moderator and school may not be able to reach agreement.  If this happens then the moderator will inform the moderation manager who will:
·         discuss any concerns initially with the school’s designated moderator, by using the national exemplification materials
·         if the issue is not resolved, the moderation manager will contact the school by phone or email
·         the moderation manager will speak with the moderator to discuss the moderation visit and note the moderator’s account of details
·         schools must have evidence to support any appeal claim before the appeal is processed (the evidence can only be based on that validated during the LA moderation visit)
·         all outcomes will be documented and all parties involved in the complaint/appeal will sign
·         outcomes from the complaint/appeal will be noted in a transparent way for the head teacher and the LA to keep on record.
·         If agreement cannot be reached with the moderation manager the school will be offered the opportunity to refer the matter to another LA, in which case the moderation manager and the school will agree to abide by the decision of the other LA.
·         If the school does not wish the case to be referred, then the moderation manager makes the final decision about the levels to be reported.

Deadline for Appeals

Appeals must be received in writing within two working days of the date of the moderation visit

The authority takes any complaints or queries very seriously and will respond to and resolve them as quickly as possible.

Please be aware:
‘Schools may request a review of the moderation judgement but must pay any costs, unless the review upholds the school’s challenge’.  DfE
